If you are a licensed health care worker in the state of Illinois, and your professional license is currently permanently denied or revoked, there may be hope for you if you meet certain requirements.
Under Illinois statute 20 ILCS 2105/2105-165, health care workers may file a Petition for Review, requesting that the Illinois Department of Financial and Professional Regulation (“IDFPR”) review their license status and have their license restored to a status of “active.” In order to qualify for this review, you must satisfy ALL of the following requirements:
1. Be a health care worker as defined in 68 IAC 1130.210;
2. The reason for your permanent denial/revocation was a prior forcible felony conviction, that does NOT include:
a. Felonies requiring registration under the Sex Offender Registration Act,
b. Involuntary sexual servitude of a minor, or
c. Criminal battery against any patient in the course of patient care or treatment:
3. Your date of conviction must be more than five (5) years ago OR your date of release from confinement must be more than three (3) years ago, whichever of these timeframes comes later.
If you meet all of these requirements, we can help you submit this Petition for Review. There are certain documents and arguments that we know are more persuasive with the IDFPR after hundreds of licensing cases. If you are interested in restoring your license under these conditions, please call our office.
